2. Eligibility

You represent that you have the legal capacity to enter into binding agreements and that your use complies with all applicable laws. You may not use the service if you are located in any jurisdiction where cryptocurrency trading is prohibited or restricted.

3. Service Description

ai Swing X is a self-hosted automated cryptocurrency trading platform that integrates with your Coinbase account. The platform executes buy and sell orders automatically based on user-configured strategies (e.g., RSI, MACD, Bollinger Bands, Market Regime).

Important: This software does not custody, hold, deposit, or withdraw your funds. All assets remain in your own Coinbase account. The platform only sends trading instructions via API to your connected exchange account. You are solely responsible for your Coinbase account, API keys, and all trades executed on your behalf.

Consent to Automated Trading: By connecting your Coinbase account and enabling automated strategies, you expressly consent to the platform placing buy and sell orders on your behalf via the Coinbase API. You understand that trades may execute automatically without additional confirmation from you.

4. Not Financial Advice

This software and all related services (including data, insights, recommendations, and automated trading signals) are provided for educational and informational purposes only. No content should be interpreted as financial or investment advice. Users are encouraged to consult a qualified professional before making any investment decisions.

5. Third-Party Services

This service integrates with third parties including Coinbase (trading) and Telegram (notifications). Your use of those services is subject to their respective terms and policies. We are not responsible for the availability, accuracy, or conduct of any third-party service. Failures, outages, API changes, or restrictions imposed by third parties may affect service availability and are outside our control.

6. Investment Risk & Disclaimer

Cryptocurrency trading involves substantial risk of loss. The software does not guarantee returns. All investment decisions are the sole responsibility of the user. Past performance is not indicative of future results.

Automated Trading Risks: Algorithm execution may fail due to technical issues, API downtime, connectivity problems, or market conditions. We assume no responsibility for losses resulting from automated trading, strategy failures, or system errors.

7. Limitation of Liability

To the fullest extent permitted by applicable law, the software operators shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising from the use of this service, including but not limited to: trading losses, missed opportunities, system errors, API failures, data breaches, or unauthorized access.

8. No Warranty

The service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant uninterrupted access, error-free operation, or that the service will meet your requirements. We disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.

9. Indemnification

You agree to indemnify, defend, and hold harmless the software operators from and against any claims, damages, losses, costs, or expenses arising from: your use of the service; your violation of these terms; your trading activities or investment decisions; or any dispute involving your Coinbase account or API keys.

10. User Responsibility

Users must verify the accuracy and appropriateness of any information provided by this service. The platform does not guarantee any investment results, profits, or outcomes.

API Keys & Account Security: You are responsible for safeguarding your Coinbase API keys. Do not share them with third parties. We recommend using API keys with trade and balance permissions only, and disabling withdrawal permissions for security.

11. Prohibited Activities

The following activities are strictly prohibited: unauthorized data scraping; unauthorized access; sharing or exposing your Coinbase API keys; manipulating or abusing the automated trading system; using the service for illegal activities; and all actions that contradict the intended purpose of this software.

12. Governing Law

These Terms of Service are governed by the laws of the jurisdiction where the service is operated.

13. Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, war, natural disasters, exchange or API outages, internet or power failures, or cyberattacks.

14. Severability

If any provision of these terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.

15. Changes to Terms

These terms may be updated without prior notice. Continued use of the service after modifications constitutes acceptance of the revised terms.

16. Acknowledgment

By using this software, you acknowledge that you have read, understood, and agreed to these Terms of Service and our Privacy Policy. You consent to automated trading on your behalf and accept all risks associated with cryptocurrency trading. If you do not agree, please stop using the service immediately.
